"CIPsoft has filed for bankruptcy

The recent news that CIPsoft has filed for bankruptcy should alarm those who take part in the online games which the company provides, as they will be without constitutional protections guaranteed to allow open access to the court.

There are very legitimate and compelling reasons to take measures to salvage a company such as CIPsoft. The jobs of many hard working IT experts hang in the balance. In addition, CIPsoft is the provider of several popular services which hundreds of thousands of people enjoy worldwide. Given this, why doesn’t it make sense that relief from claims resulting from the company’s negligence in their product manufacture should be forgiven? Let’s take the example of a father and child, both enjoying the services offered by the gaming company. The servers have been known to be under attack and personal information stored there having been unveiled before. Both financial information used to purchase the companies products as well as personal data such as addresses, and other information perhaps vital for commercial hackers are, could end up in the hands of said commercial hackers. The European court has set a fine of €250,000 for companies which do not take proper measure to avoid such damage. However, seeing as the bankruptcy renders them immune for such trials these fines will ultimately paid by the consumers of their games. The high-tech hardware which still has a residual value will be sold per highest bid, therefore removing all stored data including the current progress off the game.

In an attempt to avoid this situation Blizzard has stepped to German court attempting to purchase the entire list of assets remaining in CIPsofts arsenal. These however appear to be a futile attempt as both gaming companies contribute to the same markets. European law dictates that, in the case of companies holding personal information, such purchases will only be allowed with the consent of each customer. Consider the size and spread of the CIPsoft customers this seems to be unlikely.
While those with pre-existing claims will likely receive little or no compensation, Cipsoft has said that it plans to continue to guarantee warranties on privacy and safety. One of the consumer attorneys pointed out the ridiculousness of this. “They’re saying, ‘If our security measures are bad, we’ll fix them. But in case of cyber crime, we don’t want to be accountable for that.”
Some critics of the proposed bankruptcy plan are lobbying to establish victims’ compensation funds. Though such funds would severely limit the amount of money available to those personally damaged killed by defects, they would provide them with at least some monetary recompense. However it appears that determining the causal relationship with damage and CIPsofts neglect will be a long and costly road to failure.
Within the next 6 months CIPsoft will publically announce whether or not the company will be saved by a third party. Currently its servers are still running and it is expected to stay that way for at least 2 months while the company is being reviewed. At the end of March interviews will start with interested parties. Until now there have not been any noticeable problems for the consumers however unless the company manages to find an outside investor within the next 6 months, all services will be terminated and servers put offline. Whether or not all files will be deleted afterwards is not known, it has been noted, however, that consumers will not be compensated for purchased services."
