generalnie wiekszosc osob pisze, ze obopolna zgoda musi byc podstawa, aby zostala podpisana war declaration, jednakze powinny byc od tego odstepstwa, by mozna bylo jakos zmusic trouble makerow do wojny, troche mniej osob pisze, ze zgoda jest niepotrzebna, ale powinny tez byc od tego odstepstwa, zeby nie mozna bylo tego wykorzystywac, nie wiem jednak jak oni chca jakikolwiek system do tego wymyslec, tu raczej potrzebny by byl jakis personalny osad, a nie system, ktory bedzie zliczal kto kogo ile razy zabil lub jakies inne durnoty :/

No, it simply doesn't work out the way it's supposed to be. Big guilds that dominate server by sheer number and levels can't be forced to war-mode. This is one of the major flaws. In the skull system it's all about level and numbers and that's wrong. It also gives higher level botters (that usually team up with eachother) the advantage over the fair players.
You should be able to force people that are pvp-active to war-mode. I already had an idea about it but it's still incomplete and has many flaws.
It's really hard making a system in which u can force war-mode upon your enemies though a system in which you shouldn't be able to force war-mode upon peacefull minded players.

I would like to give an example of it.
We used to be the leading guild of Hiberna, led by Don'tribioni, me and Rosenda (also from this focus group)were vice-leader. At that time Hiberna was a good place for neutral players. We didn't like power abusing and random pking, because it's simply not worth losing your face for (it's not fun ruining someone's day just for a boh, since we had all been kicked out from Lucera we had the experience of being power abused and random pk'd)
At some period of time a big group of Arcanians transferred to our servers. They used to be our friends but it turned out that they were big trouble makers. Also the reason they got kicked out of Arcania. We got into a fight with them. They of course joined our ex-enemy side. They tried fighting with us in war-mode but got completely crushed (even with their bots). And they decided not to use war-mode anymore.
After the disbanding of war-mode we still hold Hiberna for about 4 months. But the fights were so utterly boring that we decided to move to Kyra were there was always war-mode.
This turned into Hiberna being ruled by those trouble makers until this day. Power abusing and random pking has become a big problem in Hiberna. People have offered us 20kk of cash coming back to Hiberna. And kick those guys out. But the simple fact remains they will never use war-mode. They might though, but the moment they start losing they will leave it.
Cause of this my old server is being dominated by some botting kids that power abuse and random pk every day. I would love to kick them out, but we simply can't do it because of the skull system.
This is a big problem that needs to be solved!
2) Should there be any exceptions to the above?
As said before peacefull neutrals shouldn't be able to be dragged into war-mode.
3) What should be the main motivation on Open PvP to fight wars?
Thrill, excitement, Reputation and ofcourse helping out your friends.
4) What kind of motivation should be discouraged here?
Hunting peacefull minded players of a server. Though if someone starts a war he should be able to be hunted off for a certain period of time. That's the risc you should take by joining a war. It's also one of the things that makes a war excitening.
5) Is there something that should not be part of Open PvP wars?
Swapping, 3rd parties healing people involved in war-mode. 3rd parties in general.

No, the flaw is before going to war, booth sides have to agree, so a mutual agreement, as it is now, doesn't work.

The sollution is to force people into war-mode, tough the brilliant idea of fixing this, never came up to someone and I think this is rather impossible to fix.

To prevent people from doing what ever they like to, to protect the innocent, to make people behave well to each other, for the thrill and for the competitive motivation to get high and fight.
4) What kind of motivation should be discouraged here?
Innocent getting harmed.
5) Is there something that should not be part of Open PvP wars?
3rd parties healing people that fight inside war-mode,
surrender mode,
3rd parties interferring,
